Loomepaik (operated by Alphex OÜ, Estonia) provides accommodation for creative retreats and private stays. By submitting a booking request and paying the invoice, you agree to the following terms.
1. Booking & Payment
- A booking request becomes a confirmed booking only once you receive a written confirmation from Loomepaik and the invoice has been paid in full.
- Payment must be made within the due date shown on the invoice. If the invoice is not paid on time, the booking is automatically cancelled.
2. What’s Included
Unless otherwise stated, the booking price includes:
- Accommodation in the Loomepaik apartment in Treimani, Estonia
- Utilities (including winter heating)
- Bed linen and towels
3. House Rules
- Guests agree to respect the apartment, the surrounding environment, and the peaceful atmosphere of Loomepaik.
- Detailed house rules are provided together with the booking confirmation and form part of this agreement.
4. Consumer Rights & EU Law
- Normally, EU consumers booking online have a 14-day right of withdrawal (cancellation without reason).
- However, according to Article 16 of EU Directive 2011/83/EU, this right does not apply to accommodation services for specific dates or periods.
- Since all bookings at Loomepaik are tied to specific dates (check-in and check-out), the 14-day withdrawal right does not apply. Instead, our cancellation policy (below) governs all bookings.
5. Cancellation Policy
- 21 days or more before arrival → full refund.
- 15-20 days before arrival → 50% refund.
- 14 days or less before arrival → non-refundable.
- No-shows or early departures → non-refundable.
Host Cancellations
- We are committed to honoring all confirmed bookings.
- In the very rare case of extraordinary circumstances beyond our control (such as natural disaster, political instability, or personal emergency), we may need to cancel a booking. If this happens, all payments will be refunded in full. If a stay must end earlier due to extraordinary circumstances, we will refund all unused nights in full.
All eligible refunds will be processed within 14 days of receiving the cancellation request.
6. Liability
- Guests are responsible for their own belongings and personal safety during their stay.
- Loomepaik is not liable for loss, theft, accidents, or damages caused by the guest’s own actions or negligence.
- Any damage caused to the apartment or its contents during the stay must be compensated by the guest.
7. Governing Law
- These Terms of Service are governed by Estonian law and applicable EU consumer protection regulations.
- In case of disputes, guests are encouraged to first contact Loomepaik to find a friendly solution. If needed, disputes may be settled through the Estonian Consumer Disputes Committee or competent courts in Estonia.
